2026: Changes to Oregon’s set-aside statute, ORS 137.225 under HB 2492 took effect Jan. 1, 2026. The changes include longer timelines for setting aside certain abuse-related contempt findings, clarification of waiting periods after felony reductions, and clarification of timelines following no-filed and dismissed cases. HB 2492 also eliminated the argument that traffic violations could be set aside under the post-2022 version of the statute. The updated 2026 Expungement Guide incorporates these changes and clarifies other tricky eligibility issues, including sex crimes and child- and elder-abuse cases.
