This presentation lays out the process of requesting police disciplinary records through the subpoena duces tecum process. The presentation will cover the subpoena, issues with the city’s motion to quash, and what arguments to raise at the motions hearing. Requesting police disciplinary records is important for so many reasons – it provides attorneys with potential impeachment material at trial, it makes the police nervous, it makes the DAs nervous, and increased requests/litigation on this issue could improve police transparency in Oregon. What happens when a client drops evidence in a lawyer’s metaphorical lap? Can the lawyer put it in an evidence locker, test it on her own, or just give it back to the client? Does it matter if the lawyer never actually touches the evidence? Or if the evidence is contraband or an instrumentality of a crime? This panel will explore what lawyers should and must do when they come into possession of evidence. The panel will discuss the ethical and legal constraints on a lawyer, provide guideposts for lawyers to follow, and discuss how best to turn over evidence, if required.
